1. GENERAL TERMS AND CONDITIONS
1.1. Current consumer legislation regulates consumer purchases of goods over the Internet, including the Consumer Purchase Act, the Cancellation Act, the Personal Data Act and the E-commerce Act.
1.2. These terms and conditions ("Terms") apply to your order of products ("Products") from Ellen Kvam Norwegian Design AS's online store for delivery outside of Norway. See Section 11 on "Privacy Policy" regarding our use and storage of personal data.
1.3. The following terms are made for all purchases. By agreeing to Ellen Kvam Norwegian Design's General Terms and Conditions for Online Store before your order is submitted, you agree to these terms and conditions.
1.4. Ellen Kvam Norwegian Design AS reserves the right to change the terms without notice. Such a change will not affect orders that were sent before the changed terms are posted on the website.

2. REGISTRATION OF ORDER
2.1. An order is registered by following the method of ordering on the website
2.2. All products are subject to availability. We will contact you by e-mail or phone as soon as possible to inform you if the ordered products are not available.
2.3. We strive for high quality items, but please note that the ordered product may vary in color and design from the image on the website.
2.4. We make reservations for typing errors and pricing errors. You will be informed by phone / mail and the online order may be canceled.
2.5. If you have provided a valid email address, we will notify you as soon as possible to confirm your order and to confirm your details. In connection with this, you will receive a unique order number, which shall be used in all communication with Ellen Kvam Norwegian Design AS.
3. DELIVERY
3.1. The ordered products will be delivered in their original design. Ellen Kvam Norwegian Design AS reserves the right to make minor technical changes that do not affect the functionality of the product.
3.2. Some of the products are handmade and may therefore vary slightly from the product depicted on the website.
3.3. Product availability may vary. If the products are not available within the estimated delivery time, you will be notified.
3.4. If a product is not available in the quantity ordered, you will be notified and you can decide if you want to order a lower quantity or cancel the order.
3.5. If delivery is not possible within thirty (30) days, you may cancel your order. Should payment have been made, you will be refunded within thirty (30) days.
4. PRICES AND DELIVERY COSTS
4.1. All prices are in NOK. Prices published on the website include VAT, but excluding any fees, customs and shipping, unless otherwise stated. For international orders (delivery address outside of Norway), Norwegian VAT is not included. Ellen Kvam Norwegian Design AS is not responsible for additional costs (VAT, tax, custom’s fees) that may accrue on international shipments. Please check local legislation in your country before your order.
4.2. Fees, customs and shipping may vary, as well as delivery method. The total price quoted on the order does not include the items listed in Section 4.1 on international orders.
4.3. You agree to refund Ellen Kvam Norwegian Design AS for any additional shipping / handling costs that arise as a result of your failure to accept or collect delivery in accordance with the agreed terms of delivery.
5. PAYMENTS
5.1. You can pay for the products using the applicable payment methods specified on the website.
5.2. Ellen Kvam Norwegian Design offers secure online payment with the help of an external provider. To ensure that you always have the highest degree of security, the payment details are automatically encrypted.
5.3. When paying by credit card, credit card details must be provided when ordering. Your credit card will be charged at the time of order confirmation.
5.4. Choosing Cash on Delivery as payment method may accrue collection fees from the local postal entity.
6. CANCELLATION, DAMAGED AND/OR DEFECTIVE PRODUCTS, DISPUTE RESOLUTION
Cancellation/Withdrawal
6.1. Under EU rules you can, without giving any reason, withdraw the order, from the date of receipt of order confirmation, up to 14 days from receipt of the product. Such withdrawal shall be in writing (eg letter, fax or e-mail). In order to comply with the deadline, it is sufficient to send the withdrawal notice to Ellen Kvam Norwegian Design at the address or e-mail specified in Section 1.5.
6.2. International orders outside the EU area will follow the same rules as Section 6.1.
6.3. Should payments have already been made, you will be refunded within thirty (30) days of receipt of the returned product. However, we will only cover the cost of the product itself and not your delivery cost to return the product to us, or postage for the item sent.
6.4. The right to withdraw your order is waived if you have not taken sufficient steps to ensure that you are able to return the product in substantially the same condition as its original condition. In order for the right of cancellation to apply, the product must be unused and returned in its original packaging intact. This does not apply if the condition of the product is worsened as a result of circumstances that are not caused by yourself. In any event, we will always recommend that you take adequate and reasonable steps to maintain the condition of the product and ensure that the product is returned safely back to us.
6.5. The right of cancellation does not apply if the product is sealed and the seal is broken. The right of cancellation also does not apply to products that are specially designed or modified according to the buyer's specifications, or sealed goods that are not suitable for return for health or hygiene reasons and where the seal has been broken after delivery.
Damaged or Defective Products
6.6. In addition to your right to withdraw the order, you may also exercise certain means if you find that the product is damaged or defective. If yes, please contact us and follow the procedures listed below.
6.7. Any damage to the products during shipment or alleged defects regarding the product must be reported immediately to Ellen Kvam Norwegian Design at the address or e-mail specified in Section 1.5.
6.8. Other complaints or obvious defects must be notified within thirty (30) days of receipt of the product.
6.9. If the claim is valid, you are entitled to repair or replacement free of charge. If the product cannot be repaired or replaced, you are entitled to a refund or price reduction.
7. FORCE MAJEURE
7.1. If delivery is prevented or delayed due to circumstances beyond our control, we are entitled to cancel the order. You will be notified by mail, email or phone.
8. APPLICABLE LAWS
8.1. This Agreement is governed by the Consumer Purchase Act, the Cancellation Act, the Personal Data Act and the E-commerce Act (all Norwegian). For International Orders, the agreement is governed by either EU legislation or Norwegian legislation, depending on which legislation provides the best protection for you as the customer.
9. AGE LIMIT FOR PURCHASE THROUGH ONLINE STORE
9.1. Anyone buying something through Ellen Kvam Norwegian Design's online store must be 18 years or older.
10. PRIVACY POLICY
10.1. We collect and store any information you enter on our website or provide us in any other way. In connection with purchases in the online store, personal data will be obtained, such as name, address (e-mail or physical address, IP address, telephone number, etc.). We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page.
When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. This data is only used internally in connection with the shipment of goods, customer contact, etc.
Data collected on the webshop is not shared / sold to a third party, and treated and stored according to Norwegian law.
We collect such non-personal and Personal Information for the following purposes:
- To provide and operate the Services;
- To provide our Users with ongoing customer assistance and technical support;
- To be able to contact our Users and Visitors with general or personalized service-related notices and promotional messages;
- To create aggregated statistical data and other aggregated and/or inferred non-personal information, which we or our business partners may use to improve our respective services;
- To comply with any applicable laws and regulations.
How we store and use your Personal Information:
Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products to you. Your data may be stored through Wix.com's data storage, databases, and the general Wix.com applications. They store your data on secure servers behind a firewall.
All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by the PCI-DSS as managed by the PCI Security Standard Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
How we communicate with our store Visitors:
We may contact you to notify you regarding your account and order, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, marketing campaigns, promotions, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.
10.2. The online store and its associated pages collect data using "Cookies". Cookies are small pieces of data stored on a site Visitor's browser, usually used to keep track of their movements and actions on a site. Data obtained in this way is used for statistical purposes, such as site performance measurement and more. Provider of measurement tools is Google Analytics. Data collected by "cookies"is collected anonymously, and used only by Ellen Kvam Norwegian Design for statistical purposes.
